Disorderly Conduct misdemeanor

I recently in the past 2 months got a citation for disorderly conduct for being with drunk people. I am now being charged with theft and my attourney is talking about the ARD program for first time offenders. My question is will this disorderly conduct keep me from getting in the program, or will it even show up?? disorderly conduct does not mean that i am a first time offender does it?? other than that my background is perfectly clear. thanks!

Admission into the A.R.D. program is discretionary with the Office of the District Attorney. If the Disorderly conduct was a summary offense you may still be eligible for admission into the ARD program but I'm fairly sure that it depends on the policy of the District Attorney in your particular County. I don't know of any cases holding that it is an abuse of discretion for a D.A.'s office to consider summary offenses. Your own attorney is undoubtedly aware of the policy in your county and he or she is the best one to discuss this with.
