disorderly conduct non traffic summons

My 17 year old was at a party where there was underage drinking. Police were called due to noise. Officers only cited them with disorderly conduct because they were polite to police. I plan on fighting the disorderly charges at DJ level. Can the citing officer then change, add or amend the charges to underage drinking?

Yes, the officer has the ability to withdraw the DC and file an underage drinking which would expose your child to loss of license etc. Normally, when a child is cited for underage, if he in fact was drinking and the case is strong, we try to change the charge to DC.

Good luck, but remember that underage drinking has a penalty that gets worse the more you get convicted.
