DUI with Assault by Vehicle
My 25 year old son was in a auto accident and was taken to the Trauma Unit for emergency admission and surgery. The ER tested for BAC and Drug Screen since he was unconscience. His BAC came back possitive. He was then discharged home. He was told by police to turn himself in at the police station. He was then taken to the county jail and has been there for almost a month. He did have a bail hearing and was never advised of his rights and that he could have legal counsel. He now has been assigned a public defender. He is stating that he was never informed of his rights and was told by police to write a statement of the accident. I'm not quite sure what to do at this point. His bail is set at $35,000 and the county is denying a 10% retainer. I am considering consulting an attorney in this matter but really do not know what to do since he is an adult.

You need to consult with a private attorney as soon as possible. Even though it's his first time, it looks as if he was in an accident, so he may not be eligible for A.R.D. Plus, I don't know from your facts what happened to the other automobiles or passengers. Call me to discuss if you like.
