DUI, second offense
A family member received a DUI in June 1997 and lost his license for 30 days, went to classes and paid a fine. He received another DUI in November 2006. Does he need an attorney if he pleaded guilty? We are trying to avoid jail time. What are the odds he'll get jail time?

The odds of getting jail time for a second offense DUI are 100%. It's a mandatory sentence. The amount of time depends on his blood alcohol level.
He should have had an attorney BEFORE he plead guilty. Getting an attorney afterwards doesn't make any sense at all.
You may be able to get house arrest or work release, depending on the county you are in and the details of the offense.
