Legal Question in Criminal Law in Pennsylvania
can an employer hold your last paychecks/401K after they fire you, the company pressed charges against me for theft and fraud, never went to court, took a plea to pay restitution back, was fired over a year ago

It sounds to me like they are holding the last paychecks and the 401K to pay restitution. If the amounts are higher than the restitution owed, I think they may have to release the balances to you. The 401K may have to be released to you regardless.
