Legal Question in Criminal Law in Pennsylvania

false charged filed against someone

my friend's roommate filed completely bogus charges against my friend's boyfriend, saying that he sexually assualted her. how long will it take to make them go away/ have him be proven innocent? also is there anything that he can do to counter her charges against him? should he hire a lawyer now or wait until he's formally charged?

Yes, your friend should hire a lawyer now. Early investigation by the lawyer can/will make the difference between obtaining a "not guilty" at trial. Often, the lawyer can help reduce the number of charges or type of charges that eventually get filed against your friend. Regardless, just because your friend is being "framed" by this girl does not mean that his innocence will be apparent to those involved. He should not make any statements to any body about this. If approached by law enforcement, he should simply and politely state that "on the advice of counsel, I am choosing to not make a statement at this time."

Your friend is looking at serious charges that require the attention of an experienced criminal defense lawyer. Make sure he does not make any statements to any body; make sure he gets an expereinced lawyer; make sure he has a full and thorough preliminary hearing; make sure he has some money to bail himself out of jail once and if he is arrested.

Good luck, and if your friend has any more questions, please feel free to contact me. Good Luck.
