Legal Question in Criminal Law in Pennsylvania

Felony Pardon's

I was convicted back in 1995 of a felony. I am a sports man and a hunter. How do I get my rights back to own a gun again?

Re: Felony Pardon's

The Pennsylvania statute is at 18 P.S. section 6105. It covers only various offenses. You have to also look at the Federal Statute, though. That's at 18 U.S.C. section 922. If the crime was punishable by a term of imprisonment for over one year, as all felonies are in Pennsylvania, then the federal statute applies. You would have to get the record of your conviction expunged to qualify under the federal statute. If you have any doubts, it is best to check with the Pennsylvania State Police before you try to buy a firearm of any kind.

Re: Felony Pardon's

You don't...not without a pardon from the Governor (or President, if it was a federal crime). Convicted felons are not allowed to possess firearms.

Assuming that it was a state charge, you have to contact the PA Board of Pardons, and go through the process there to seek a pardon.
