Legal Question in Criminal Law in Pennsylvania

My fiance was charged with drug possession (misdemeanor) in March 2009 and was sentenced with one year of probation. Now, his probation officer just issued a warrant for a violation and we don't even know what the violation was. What are the penalties/consequences for this alleged violation?

It depends on what type of drug possession charge he originally pled guilty to. If it was possession of a controlled substance, the potential penalty is 6mos-1yr.

There are different types of vilations...and a violation an entirely new charge. You should consult an attorney immediately. Don;t ignore the situation. Also, some judges might be stricter than others on violations.

I assume he used the public defender, so the public defender will be there to assist again....

A true violation (failing a random urine, a new conviction or another breach of a major condition of probation) can result in the Judge vacating the old probation and resentencing the offender.

In some cases, that means jail. But in most, it means a new, extended term of probation.
