Legal Question in Criminal Law in Pennsylvania
My fiance was driving a car for a friend of his who doesn't have a licence. His friend was in the car too. They were pull over for tinted windows when they decided to search the car. They found a bit of heroin in the back seat of the car.. my fiance did not know there were drugs in the car. He cannot afford a lawyer so his friend's mother is getting him a lawyer so that he will represent both of them.... I have not spoken to the lawyer but the friends mother said he needs the birth certifcates for his children, an old I.d. and the address to where he use to work at... I'm not sure how this goes but it doesn't make sense into why he would need this information... so my question is, is he suppose to ask for the childrens' birth certifcate for this type of case?
1 Answer from Attorneys
First it might be a conflict to have the lawyer represent both of them.
Second, he should say nothing to the police.
Third, no that information is not needed.
