Legal Question in Criminal Law in Pennsylvania
Firearms on School Property
There is a security guard that attends school events. He carries a 9mm handgun, along with pepperspray and handcuffs.
I do not believe it is legal for him to be carrying the weapon on the school property.
To the best of my knowledge he does not possess ACT 235 lethal weapons training, which is required for all privately employed persons who utilize a lethal weapon in the performance of their work.
He is also not a law enforcement officer.
A concealed weapons permit would not cover him according to 18 PA Stat. Ann. 101 because it IS a publicly funded school, licensed by the Department of Education.
My question is are there any stipulations I have over viewed?
