Legal Question in Criminal Law in Pennsylvania
Do I have to give information?
I witnessed a crime. One person has been charged with a felony and the other person who co-conspired with her has not been charged with anything because the police do not know he was involved. If I don't tell on him and the police find out that I knew, could I be in legal trouble as well? The one person was charged with felony interference of child custody - or something like that. In all actuality, the child in question was residing in the home of the person who was not charged with anything. This person was aware that the child was there illegally. I did not know it was illegal until the child was already returned home. Can I be in trouble for withholding this info? The police do not know who I am and have never questioned me - so should I offer the information to them to protect myself?

Re: Do I have to give information?
I don't think that you have any affirmative obligation to go to the police in this situation. If the police come to you then you may want to, at least briefly, consult with an attorney.
