Legal Question in Criminal Law in Pennsylvania
Grading of offenses
How can you determine if the charge for a disorderly conduct is a summary offense or a 3rd degree misdemeanor? If there is a charge under Chapter 55 Sec 5503(a)(4) and Sec 5503(b) states that if the intent of the actor is to cause substantial harm or serious inconvenience it will be a misdemeanor - how does one know what they have? a summary offense or a misdemeanor?
Thanks

You are entitled to know the gradation of your charge. Ask your lawyer or the district attorney and they will tell you.
