Re: Hearing
A suppression hearing is held at thr request of the defense attorney to try and have evidence ruled inadmissable, that is suppressed, for purposes of the trial. Usual subjects for suppression:a confession was given without rights being read or after an attorney was requested and the prosecutor now wants to use the confession; evidence obtained in a warrantless search. The court's decision on wether to suppress the evidence or not has a major impact on the charges- charges can be dismissed for lack of evidence or on the flip side, the prosecutor now has a sitting duck because he has a confession he can use at a trial.
