Legal Question in Criminal Law in Pennsylvania
my husband has a restraiing order against me but he is following me and trying to make contact what should i do
1 Answer from Attorneys
Thank you for your question.
What your husband is doing is common. People who have restraining orders ("Protection from Abuse", "PFA") against another individual will try to make contact with them so that they can accuse them of violating the PFA when, in fact, it was they who made the contact.
When a PFA is entered against someone, the person holding the restraining Order will give a copy of it to the police department in their area. It would be a good idea if you went to the police department with your copy of the PFA, tell them that your husband has been following you in an attempt to report you for violating the PFA, so that if your husband tries to report you for a violation, the police will know that it was probably your husband that initiated the contact and you did not violate the PFA.
