Identifying D.U.I. In An Auto Accident
My husband was driving my car under D.U.I. suspension, and was involved in an accident. After being pulled out of the car, they arrested him for D.U.I. and requested a blood test, which he agreed to. Is this normal procedure and is it even legal? His D.U.I. occured 6 yrs prior, but was never "cleaned up" on his license. (It is has been suspended since he was a juvenile - he has never even had a permit) - - In addition, is the accident automatically charged as his fault because his D.L. is suspended ???

Your husband is looking at potential jail time if this is his 2d DUI, regardless of when the first occured. Do not mess around. Get an attorney now.
