1 Answer from Attorneys
Drugs and Guns
The answer depends upon the specific facts of the situation. For example, were the drugs and/or firearms on you? Were the drugs and/or firearms out in the open or visible from where you were? Were drugs being sold out of the house when you were present? Did you have large amounts of money on you? If so, you could be wrapped up into the conspiracy. There is a new mandatory minimum law in effect - if you are found guilty of possessing drugs with intent to distribute and also possess a firearm, the minimum sentence is five to ten years.
Very often the police will raid a house and arrest everyone inside. This can include dealers, users, family members, or innocents. Even in cases where a person had no idea there were drugs and guns in a house, the allegations and charges are extremely serious. I recommend that anyone in such a position retain an attorney or obtain a public defender immediately.
