Legal Question in Criminal Law in Pennsylvania
illegal entry by police?
I live in a second floor apartment inside a 3 story house converted to apartments. A resident of the third floor gave police access to the interior of the building by opening a locked door that leads to stairs that take you to the second and third floors. This resident had called police about a fight on the first floor. While they were there he told the police that underage drinking had been going on and males were passed out upstairs. When the police came up they found me drunk inside a bedroom, the door was open. They found another guy in a room with the door closed. Should they have even been upstairs? Is this an illegal entry by police?

Re: illegal entry by police?
Issues regarding illegal search and seizure are very fact specific and I would need more information to determine whether the police entry to your apartment was legal. If you have been charged, you should contact an attorney immediately so that you don't miss the opportunity to file a motion to suppress evidence found if the search was illegal. I offer free consultations.
