Legal Question in Criminal Law in Pennsylvania
illegal search or not???
My bedroom at my house was searched by cops after
my elderly grandmother pushed her lifeline button
because she thought someone broke in. They called
my mom to search the house for the person. Then they
called her back and asked her if they could do a
complete search of my room and she said yes.they
found 3 bongs(homemade),a digital
scale,a(homemade) bowl,and some baggys but no
weed only resin in the pipes.Did they have the right to
search my room?My mom only has like a 3rd grade
education she didn't understand what the cops said! So
what can they charge me with?? the stuff wasn't mine it
was my boyfriends.

The search sounds legit to me, unless you can prove your mother 1.) didn't own the property and therefore could not give the permission and/or 2.) she was not capable of granting permision to the police. the next question where were the items in plain view or in a small draw...if they were in a small drawer, then the police would have no reason to look in such a place....bottom line retain an attorney prior to the charges being filed!
