illegal search

my fiance was sleeping with my two year old child the child woke up and got outside the police got him and brought him to the house when they came to the house jon the fiance was still sleeping it was a simple mistake he is a really good father. when they came to the hhouse they searched it and found three marijuana plants in our closet that did not have buds on them therefore there was no thc. they also found a bowl and a small amount of weed. but they came there for one reason and turned it into something else can i get a lawyer for him and fight that since there was no search warrent?
