Legal Question in Criminal Law in Pennsylvania
insurance fraud
I purchased a car in North Versailles at a buy here pay here place. I've had it for 6 months. Somebody hit me in the rear driver door. I got their insurance information and called. It was Progressive Insurance. They came and gave me an estimate and then later a $1500.00 dollar check to get my car fixed. The place I got the car, came and took my car and said they should have gotten the insurance check. They wont give me the car back. I know have no way to work and been on leave of absense. Is he allowed to do that?

Re: insurance fraud
I don't get it. Is the car (the title) in your name? If it is, then the insurance check belongs to you. Even if it isn't, I'm not sure what possible reason they could have to take the car. Did you get it fixed?? It would seem to me that you should read your contract to see what it says...unless there's something in there that says otherwise, the check, and the car, belong to you so long as you're making your payments.
