Items take from police in house search

My house was searched by the police because my son was involved in a home invasion case. They removed items from my house but they were not used in the crime. What do I need to do to get these items back from the police? My son has been sentenced already. Also, they took a blackberry phone from the scene that was in my name. Can I get this back also?

Yes, you should be able to receive these items back. Especially since your son's case is over. You may run into problems involving forfieture orders and orders of destruction etc...that your son may have agreed to while resolving his case.

Most likely, you will have to retain an attorney to file a Petition to return property. Once filed, many DA's will research the case and often agree to return the items. Sometimes, dealing with the same prosecutor that prosecuted your son is a benefit because so they are familiar with the case.
