Legal Question in Criminal Law in Pennsylvania

out of jurisdictional arrest

there was a warrent for arrest issued for me last year. the arresting officer drove behind the car i was in into the next jurisdiction. no lights no sirens.

i was arrested arrainged and wearehoused at the local motel. at the time of arrest the office was:

1 in a foreign jurisdiction

2 did not have the warrant with in his person to show me.

a 2nd officer came tpo the sceen with the warrant to serve me.

1 is this a false arrest

2 did the officer violate the hot pursuit law by not asking the neighboring jurisdiction of the stop. i personaly saw a traffic stop where a gentalman was pulled over and the locals were called in

Re: out of jurisdictional arrest

What you should be worrying about is not your arrest by an officer out of his jurisdiction...but rather why was there an arrest warrant out there for you in the first place. You need to retain an attorney to defend you against the upcoming charges.

In regards to the stop and detention and subsequent arrest on your outstanding arrest warrant. Even if the means of the detainment might not have followed procedure...probable cause...etc...this will NOT dismiss your prior criminal charges which were the basis of your arrest. Hire an attorney before this gets worse.
