Legal Question in Criminal Law in Pennsylvania
Kidnapping/probation
My ex is on probation for violating PFA order, he has the children and will not follow thru w/custody agreement, I think he may have taken them out of state for the Holidays, I cannot get in contact w/his PO, the state police say if I cannot prove he is out of state, it is just a civil contempt and nothing they can do....any suggestions? I have not seen the children since 10/31/07, nor heard from them. My attorney is handling the civil contempt case, however is there anything else I can do criminally?

Re: Kidnapping/probation
Have your lawyer take a look at the Parental Kidnapping Prevention Act of 1980, 28 U.S.C. 1738A, and The National Child Search Assistance Act of 1990 (42 U.S.C. 5780).
