Legal Question in Criminal Law in Pennsylvania
A law was signed into action today in PA banning "bath salts and synthetic marijuana" which takes effect in 60 days (PA Bill 1006.) The wording of the Bill bans specific chemicals, plants and similar chemicals, plants. The news reported that the ban was on "bath salts and synthetic marijuana sold as herbal incense." The bill makes sense because of some crimes which were committed by basically "hallucinating" people who were using these chemicals; However there are loads of products labeled "bath salts," and "herbal incense" that do not contain any chemicals, plants or similar chemicals, plants to those banned in the bill. Is there going to be any danger in selling or possessing any products that are labeled either of these but do not contain any chemicals or similar chemicals to those banned in the bill?
1 Answer from Attorneys
It's not what they write in the paper it's what the statute says is illegal. The were going after certain chemical compounds sold for the purpose of taking them internally to get "high". They are going after Calgon or Vaseline Intensive Bath Oil beads.
