Legal Question in Criminal Law in Pennsylvania

leasing hunting rights

my mother, who lives in nys is selling a piece of land in rural pa. a man saw the ''for sale-sold'' sign and called her. his question was ''what will happen to my hunting lease, and installed tree stands?'' it appears that the hunting rights for her land were leased from my uncle. could i advertise in the local paper that anyone who leased from him should ask for their money back because he didn't own the rights?

should we press charges? seek reimbursement? he is not a nice person and i will say that many people fear him. i would like to stand up to him for once.

Re: leasing hunting rights

This is a situation where the lessee should have checked at the Recorder of Deeds Office. The lessee is in essentially the same position as a person who purchases real estate by Quit Claim Deed from a non-owner. You uncle could not convey any property rights that he did not have. The man who leased the rights may have some rights against your uncle for fraud but he has no rights against your mother.
