Legal Question in Criminal Law in Pennsylvania
is it legal for the police to search your vehicle because they claim you were loitering at a gas station even tho you got gas and was only there for about 10minutes. & is it legal for an officer to arrest you without reading you your maranda rights
1 Answer from Attorneys
When a vehicle is stopped for a nontraffic summary offense, such as loitering, if the officer has probable cause to search the vehicle, the search may be conducted. A police officer may search a vehicle if the officer has a reasonable and articulable basis to believe that evidence of a crime is concealed within. If you were stopped subsequent to a loitering charge, and the police searched your car without a warrant and found other incriminating evidence, you need to get in contact with an attorney. If you are located anywhere in the western part of the state, feel free to contact my office directly to further discuss your situation. Otherwise, find a local attorney. 724-981-1962/[email protected]
