Legal Question in Criminal Law in Pennsylvania
Not so long ago I recorded a converstaion outside between me and my ex girlfriend,
I recorded the conversation because earlier she threatened me saying she would get
a PFA against me and ruin my career, Later that day she wanted to talk to me and this
time I had a recorder on me. As we were talking again she made death threats and
said she would lie and get a PFA against me, and she would ruin my life, during
this conversation she said to me SHE HAD A RECORDER IN Her PURSE, IMPLYING
SHE WAS RECORDING ME! Can't this be used against her if she had a recorder
on her as well? And by the way she did recently get a PFA on me and called
my employer and told him she had this against me! Lets put it this way my career
is over and now I have a PFA against me for something I didn't do.
I have this evidence against her, isn't there any special cercumstances were i
can go to the DA and file charges on her?
I live in PA if that helps. Any ideas? Please shes unstable and keeping true to her
word.

I think you may be able to use the tape recording to attack the PFA against you -- have you had the contested hearing yet?
You can certainly contact your local police department and press charges for terroristic threats and/or harassment if you choose. I'm sure the cops would give your tape a listen.
Best of luck to you.

Here's the problem. You may be in violation of the Wiretap Law which prohibits recording without the person's knowledge and consent. If you go to the police and tell them about the recording, theoretically you can be charged with a crime.
I would certainly try to file charges against her, but you may wish to have an attorney with you when you speak with the police, just in case.
