Legal Question in Criminal Law in Pennsylvania
how long can they detaine you without a hearing for probation violation?
1 Answer from Attorneys
While I'm sure there is some time limit (and probably according to some Pennsylvania appeals decision somewhere), it's generally up to two months until your Gagnon/probation violation hearing is scheduled. Often, if found to be in violation, the defendant's sentence is changed to include that time served while waiting for the hearing - and then another round of probation begins. Or a new sentence can include even more incarceration time, but with credit for the time served while waiting for the hearing.
In any event, it's a good idea to have an attorney at the probation violation hearing so that the best outcome can be reached.
Hope this helps. If you'd like to discuss your particular situation further, feel free to contact me offline. I'm in Souderton, probably just blocks from you. Best of luck.
