Marital confidential communication

My husband is in jail ..two guys tried to bring contraband tobacco and alcohol in the facility ..they did not succeed ...they end up saying i threw the item out and that he planned it all ......they said they have recordings of us talking vague about things .....My question is can i use the marital confidential communication law for our phone calls ? They may charge us with conspiracy...
