misdemeanor arrest

I was arrested last week for possesion of a small amount of marijuana, I have a prior arrest for a plant in my garden in1987, will this come up as a second offense and cost me jail time?

Although technically the maximum penalty for a small amount of marijuana is thirty days in jail, it is very rare for such a penalty to be imposed. More likely, you will be fined and/or required to do some community service.

It may not cost you jail time but, depending on the county that you are in, the prior arrest may prevent you from entering the A.R.D. program.
