Legal Question in Criminal Law in Pennsylvania
Motion to terminate Probation?
Would like information on the possibilities and procedures of filing a motion to terminate probation of which I've been on for over 10 years now due to technical violations resulting in excessive reinstatements and revocations.

Re: Motion to terminate Probation?
Your attorney will prepare an order to hold a hearing on the matter. The Judge will sign it and set a hearing date. Your attorney will file the order with the Clerk of Courts. On the day of the hearing, your probation officer will appear, the District Attorney will be present, and the Judge will hear evidence and argument, then make a decision.
I only practice in Philadelphia County, and my fees, just so you have an example, range from about six hundred dollars for a very simple motion to terminate (say, in front of a misdemeanor court judge on a minor case) up to about twenty-five hundred dollars for a very serious felony case where I would get a social worker and an investigator to work the case with me.
Good luck.
