Legal Question in Criminal Law in Pennsylvania

movie theatre theft

I am possibly being prosecuted for stealing about $900. However, the money stolen was off of a gift card sold by my employer. Technically I stole money off of the people buying the gift cards as the gift cards were already paid for in full, then I used the balance on the gift cards to purchase things for myself. So I just wanted to know the worst thing that could happen if prosecuted if I am 18 and this is my first offense. ALso, what is most likely to happen since the money was not truly taken from the people that are prosecuting.

Re: movie theatre theft

The fact that the people who are identified as victims have not, according to your version, lost anything, could be a defense to your charge.

As a first time offender, you may be offered ARD, which is a diversionary program for first time offenders. After a probationary period, the charge could be dropped. Whether you are offered this is totally up to the DA.

You should contact an attorney asap. Do not go to hearings without an attorney, as an attorney may be able to evaluate your defenses and work out a deal for you with the DA.

Contact me if you wish to discuss further. I practice in Pittsburgh as well.
