what constitutes murder 1 premeditated or something else

the intent of defendant is what constitutes muder 1 and the lesser charges. also, it goes to what the D.A. can prove...if they can only provide negligent homicide, it would be wise by them to only pursue such otherwise it would waste the court's time. if you have any more questions, please give me a call.
