Legal Question in Criminal Law in Pennsylvania

non mandatory sentence

Well i have tried to talk to the attorney and he tells me that his case has been reviewed. He wont give me no more info. I was wondering since it is a non mandatory case. Dose that mean he could come home before that 18 months non mandatory sentence. Plus he has got a 12 month parole violation so i know he has to do that. But will he have to do the whole 18 month non mandatory sentence

Re: non mandatory sentence

Did your husband get 18-36 months, or 9-18 months?

If he got 18-36, he must serve all 18 plus some portion of the remaining time. He would serve the parole hit first before serving the 18 months.

If he got 9-18 months, the judge can parole him whenever the judges wants to parole him, but usually, he will serve 7-9 months of that time. As far as the parole goes, he may or may not have to serve it at all.
