Legal Question in Criminal Law in Pennsylvania

Non Traffic Citation

My 20 year old son, a resident of MD, received a non-traffic citation in Somerset County PA for attempting to use a false ID to enter a nightclub in Champion, PA. The citation states that if convicted (indicted?) he could have his driver's license suspended (if he was a PA resident). My question is this; will the interstate compact between PA/MD guarantee the same penalty when MD is notified? Should he go to trial in PA w/ a non-guilty plea or plead guilty in PA and wait until MD notifies him of an impending suspension and then fight it in court in MD?

Any help is greatly appreciated.

Re: Non Traffic Citation

It would depend upon whether MD has a license suspension for the same of similar offense. MD only has the power to suspend under MD law, so if there is a suspension in MD for false i.d. then they can suspend.

Re: Non Traffic Citation

Mr. Pascal is correct...therefore you should retain counsel for your son as soon as possible in order to avoid a possible license suspension.
