If someone received a section 17 expuncture of a misdemeanor pot possession in PA, would the board of nursing have access to that? If the lawyer claims that you can in ''good faith'' deny any charges and possible record would you still need to answer ''yes'' for the PA BON?

If you get into the Section 17 program, then you are not required to plead guilty. You enter a plea of no contest (nolo contendre). You are also not found guilty - rather, your adjudication is deferred pending the successful outcome of the program. If you complete your program, then you are never found guilty and you have the right of expungement. Check carefully to make sure that the case was expunged, as it doesn't necessarily always happen without filing a petition.
