Legal Question in Criminal Law in Pennsylvania

Pending aggravated assault case

My grandaughter is currently being held in the Cuyahoga County Ohio Jail in Cleveland. An incident happened in Grove City, PA about 2 months ago that involved her and another female. She was a passenger in a vehicle and a store clerk ran out the store trying to stop them and opened up the passenger door to the vehicle. This store clerk in the meantime grabbed a purse and fell to the ground. The Highway Patrol said she was dragged, but she was not. The store clerk immediately got up and ran back into the store. They have a holder on my grandaughter and she cannot get out even on bail in Cleveland. Do you know of a good criminal attorney in Mercer County PA, or can you represent her in this case? Can't she be released on bond and go on the fact I will bring her to PA to take care of this charge. I live in Florida but came to Ohio to help her out. She has a small 3 year old she could not be with for Christmas. Her co-defendant got out and this is the one that was the driver in Grove City, PA. If you can respond to me ASAP I will greatly appreciate this.

Re: Pending aggravated assault case

Hello. From what you're saying, your granddaughter is being held in Ohio in order to be extradited to Pennsylvania to face the charges here. She won't get out until she is transferred to PA and has a hearing.

From what you're describing, if your description is accurate, it doesn't appear that it meets the definition of aggravated assault.

I would be happy to speak with you about representing her. Please email or call if you wish.

Re: Pending aggravated assault case

One other thing. You asked if she could be released to you on the promise that you would bring her to Pennsylvania to face the charges.

That would be up to the Judge in Ohio, and would have to most likely be with the agreement of the DA in Mercer County. It's theoretically possible, but not likely. It's much more likely that the Judge in Ohio will order her held until the Mercer County Sheriff comes to pick her up. She will then be placed in the Mercer County Jail until she can have a hearing.
