Legal Question in Criminal Law in Pennsylvania

Hi, I'm from Philadelphia, PA. Two days ago I got arrested and charged with retail theft for shoplifting from Target. The amount of merchandise that I shoplifted was 2 things that were valued $149.99, around $350 total with taxes, give or take. I was held for 18 hours and was given R&R. My court date is next Thursday. I was given a court appointed lawyer. I was wondering will I be doing any jail time? This is my first offense in about 6 years. I got arrested for fraud 6 years ago, paid fines and was on probation. I'm not sure if it is still on my record because I was given a new DC number when I was processed for retail theft. Any information you can give me will be more than helpful right now. Thank you.

Assuming it is a misdemeanor (it would be a felony for a 3rd or subsequent offense), you could present mitigating evidence at sentencing such as character witnesses, medical records, proof of treatment, etc. in an attempt to get probation. A lot it depends on your prior record, however, as the judge will look at sentencing guidelines to make his determination, or the DA could plea bargain the case a recommend probation (or perhaps just a fine).
