can the police check your gps on your phone to see were you have been if you have not been charged with anythinh

Typically, the police would need a search warrant to access your GPS data. If they obtained information without a warrant which they then used to charge you with a crime, you would have a good argument to suppress that evidence in court. Of course, they could also simply ask to access your GPS and would not need a search warrant if you consented (or the owner of the car consented).
