Generally, a police officer must give the person being arrested his "Miranda" warning. However, the real issue is, "When is a person under arrest". A police officer does not have to use the words "You are under arrest" in order to be required to give the Miranda warning. If the police officer does not say, "You're under arrest", but the person is not free to leave from the custody of the police, then he should not be asked any questions without giving the Miranda warning.
