what is the average if any, jail time for a VERY small misdemeanor possession charge ?

The answer depends on your prior record and in what coutny you got arrested. In most counties, with little to no prior record, no time.

A lot depends on the County that you're in as well as on the individual judge. If it is a first offense, as Mr. Zeiger indicates, it is probably probation or time served.

Possession on Marijuana can be one of two types. You can possess a "Small Amount" (less than 30 grams) or you can be charged with "regular Possession of Marijuana. For the less than 30 grams, the maximum punishment you can face is 30 days in Jail. But, as others have stated, in most counties probation is most likely. You should try to get any of the charges negotiated down to a non-traffic offense (like disorderly conduct), which keeps your record clean.

If you are charged with possessing an amount greater than 30 grams, the charge becomes more serious. Nonetheless, unless you have a bad criminal history, jail time is unlikely.

You should know, however, if you are convicted of either type of possession, you will lose your driver's license for at least 6 months. My clients have always thought that this is a more serious punishment given that probation etc..is almost a certainty. Lastly, please call if you are also charged with any type of "intent to deliver" for this is a serious drug felony that can call for mandatory minimum jail sentences. Hopefully, you are not facing this type of allegation.
