Legal Question in Criminal Law in Pennsylvania

probation??

Hello, I was convicted of retail theft 7 years ago and received 12 years probation. I have not been in any trouble at all since then. I recently got engaged to a master sergent in the army and we plan on getting married at the end of the year, he is living in texas and i would like to transfer there to live with him. My probabtion officer submitted the interstate papers to the state of texas, but they denied me. I have talked to the county probbtion office where i would be living and they said they dont have a problem accepting me. I have been there on a few travel passes. I just dont understand why i cant move with my fiance. I am trying to better my life. Is there anyway i could get a lawyer and go in front of the judge to see what we could do ? Thank you

Re: probation??

You can file a motion with the judge for early probation termination. That would be my first suggestion, and it may well be successful. Good luck.

Re: probation??

12 years probation for retail theft??? Sounds like part of the story is missing there for sure!!

In addition to the suggestion provided by Atty. Hochberg, which is a good one and may solve the problem, if that is not successful, you will need to speak with an attorney in Texas who is familiar with the process of approving or denying these applications there.
