Probation extension

I pled guilty to felony 1 and was sentenced to 2 years probation. My probation will be completed Nov. 2008. The probation officer is now saying they may extend my probation for another 2 years. I have had no problems with my probation except the social worker assigned to group therapy. Can the court extend my probation for another 2 years? Can I fight this? My original attorney doesn't seem to have an interest in the case.

A petition to extend your probation may be filed, but it is something that you can oppose. You should have an attorney to assist you. It sounds like your case involves some sort of addiction counseling. If the person running your group counseling is not suuportive, you should involve yourself in other group therapy in addition to the court mandated so that you can bring the other counselor into court to testify on your behalf about the positive steps you are taking in your re recovery.

you can fight it. you can have a lawyer file a motion for termination of your probation at its natural expiration. the judge will then have a hearing. good luck. [email protected]
