Legal Question in Criminal Law in Pennsylvania

question about conspiracy charges

I was charged with a conspiracy to del/manuf/possession of a controlled substance.

My co-defendant has pled guilty to all charges except the conspiracy. The conspiracy was nolle-processed against my co-defendant.

Because my co-defendant pled guilty to everything but the conspiracy, refusing to plead guilty to it because he insisted that there was no conspiracy between the two of us, Can they still charge me with this conspiracy charge?

Im on the trial list for this week, the DA has yet to drop the charges against me. Can I still be tried and found guilty of conspiracy given the circumstances?

Re: question about conspiracy charges

The answer is yes, believe it or not. One person can be found guilty of conspiracy even if his codefendant is found not guilty! That's simply the way the law works. If your trial goes forward, I highly recommend that your lawyer calls your codefendant to testify on your behalf. Such testimony would be very persuasive evidence on your behalf. Good luck.
