what if the victim say she was rape cause, she said ''she was told '' someone said they had sex with her. can u have sex in 1 to 2 mins.

the burden of proof in a criminal case is on the commonwealth to make out their case. Depending on what evidence is present the commonwealth will either be able to get a conviction or not. As far as how long it takes to have sex, the answer is, only a split second. The standard is "penetration however slight." meaning, if there is any penetration at all, that is enough.

It sounds like a difficult case for the prosecution if there is no physical evidence. However, if she was passed out drunk or unconscious and there is a witness to the event, the defendant could be in a lot of trouble. This is a very serious matter and should not be taken lightly.
