Legal Question in Criminal Law in Pennsylvania
Restitution and Extradition
My fiance is currently being held in a county jail awaiting response from another state for extradition. his charges are all misdemeanors and some of the charges are 6 years old, on which he never had to seve jail time, but did have to pay restitution-which he never paid. What is the likely hood that he'll be extradited, and if we pay that restitution and court costs will those charges be taken off the warrant?

Re: Restitution and Extradition
If he was picked up on an out of state warrant he will almost certainly be extradited. If he was picked up for something else and they held him because of an old out of state warrant there may be a slim chance that the requesting state won't bother with it. If the warrant was still out there, though, it is unlikely that the requesting state won't act on it.
