Legal Question in Criminal Law in Pennsylvania

fiance got arressted 2 wks ago for filling a fake perscription for narcotics and it was done because we were threatned verbally and now he is facing state due to his background and cops have him believing the only way he can stay out is by squeling, and my fiance wants to go ahead with it, the courthouse judge told him that its up to the magistrate for the outcome, my bf has been in rehabs that he completed successfully, house arrest twice and state intermediate programs also and he stayed clean, just got caught up in my mess and now he is paying and his public defender wants to hang him, we have talked to att but they say its a wasted of money for them and to just stick with public defender, but he needs help and counseling, not jail, he is clean and a good man of two small boys, what can i do to help him, my att advised me not to talk to cops but my bf needs me to tell them he will work for them, what is gonna happen, does he have to take this plea or will they give him help rather then makin him max out? and do these cops come to preliminary''s?

You can pretty much bet that the police will be at the Preliminary Hearing. I don't know why a private attorney would turn down a case unless it's a financial issue. If there is a problem with the assigned Public Defender, he may want to request that a different public defender be assigned.
