Sentencing Guidelines
My brother was found guilty of Aggravated Assault and Involuntary Manslaughter in Delaware County. We don't understand how you can be found guilty of both of these,since we thought they contradict each other. Also, we were told there was a minimum sentence of 5 years for Aggravated Assault, but I don't see that in the Pennsylvania code book. This is a first offense, he has never been in trouble in his whole life.

With a prior offender score of 0 the sentencing guidelines are 3-12 for involuntary manslaughter and 9-16 for the aggravated assault. There is the weapons kicker of 5 years this may be the minimum he faces.
The two charges are not necessarily mutually exclusive.
