Hello
I know a man that was convicted of a crime, that happemed 34 years ago.
Does the judge have to sentence him, by the 1969 guidlines?
He was sentenced for second degree murder. And he received nine and a half, to 19 years

I would have to research the issue a bit to give you an answer that I would feel confident with. Off the top of my head, I would think that he could not be sentenced to a penalty harsher than the penalties available at the time he committed the crime. However, second degree murder is higher than a first degree felony and the traditional sentencing scheme would allow for a life sentence.
