Legal Question in Criminal Law in Pennsylvania

Sentencing

Hello

I know a man that was convicted of a crime, that happemed 34 years ago.

Does the judge have to sentence him, by the 1969 guidlines?

He was sentenced for second degree murder. And he received nine and a half, to 19 years

However, second degree murder is higher than a first degree felony and the traditional sentencing scheme would allow for a life sentence.
