Sentencing
My son was arrested on criminal conspiracy charges. He was also on probation. He is scheduled for the Gagnon Hearing on 2-1-05. Can he be sentenced for the probation violation if he hasn't went to court on the conspiracy charge?

I am afriad so. The criminal charge is proof beyond a reasonable doubt of the specified criminal activity. At the Probation hearing the judge must only find a violation of the probation conditions. I offer free consultations.

Yes...by violating the terms of his probation he can be sentenced for an additional violation..it is imperative that you retain counsel as soon as possible.
